TERMS AND CONDITIONS OF SALE - "GROUND GAME" ONLINE SHOP - LAST UPDATE: 21.04.2023
- Definitions
Terms used in the Terms and Conditions of Sale mean
- Ground Game – Ground Game Ireland, Unit M1B Smithstown Business Park, V14ER83 Shannon(IRELAND), Tax number: 2797824P
- Client – a natural person, a legal person or an organizational unit that is not a legal person, which makes Order using the Online Store;
- Consumer – accordaning to art. 22 [1] of the Civil Code means any natural person who performs acts in law which are not directly connected to his economic or professional activity.
- Civil Code – the Act of April 23, 1964 (Journal of Laws No. 16, item 93);
- Terms – this Terms and Conditionas of Sale;
- Online Store – an internet service available at groundgame.ie, through which the Client can, in particular, place Orders;
- Goods – products presented in the Online Store;
- Sales Agreement – a contract for the sale of Goods in the meaning of the Civil Code, concluded between Ground Game and the Client, concluded using the Online Store's website;
- Consumer Rights Act – Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827);
- The Act on the provision of electronic services – the Act of 18 July 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204);
- Order – Client's declaration of intent, aimed directly to conclude the Sales Agreement, specifying in particular the type and quantity of the Goods.
- RODO – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing directive 95/46/WE (general regulation on data protection) .
- General
- These Terms define the rules for using the Online Store available at: groundgame.ie.
- These Terms are the regulations referred to in art. 8 of the Act on the provision of electronic services.

These Terms specify in particular:
- rules for registering and using an account as part of the Online Store;
- the terms and conditions for making an electronic reservation of Goods available as part of the Online Store;
- terms and conditions for submitting Orders via the Online Store;
- terms and conditions of concluding Sales Agreements with the use of services provided as part of the Online Store.

Using the Online Store is possible provided that the IT system used by the Client meets the following minimum technical requirements:
- A web browser with Java Script enabled and HTML5 enabled
- The minimum screen resolution is 640x360 pixels.
- In order to use the Online Store, the Client should get access to a computer workstation or any other device with access to the Internet.
- In accordance with applicable law, Ground Game reserves the right to limit the provision of services via the Online Store to persons who have reached the age of 18 years. In this case, potential Clients will be notified of the above.
- Clients can access these Terms at any time via the link found on the home page of groundgame.ie and download it and print it out.

The rules of using the Online Store
- To use full Online Store functionality it is required to register an account (account is not required to make an Order).
- Registration requires completing and accepting the registration form, available on one of the Online Store's pages.
- To register an account it is required to review and accept Terms and provide personal data marked as mandatory.

Ground Game may deprive the Client of the right to use the Online Store, as well as limit its access to some or all of the Online Store's resources, funtions or features, with immediate effect, if the Client violates the Terms, in particular when the Client:
- provided information during registration in the Online Store that is false, inaccurate or out of date, misleading or violating the rights of third parties,
- committed through the Online Store to infringe the personal rights of third parties, in particular the personal rights of other Clients of the Online Store,
- behaves in the way that will be considered by Ground Game for behavior violating an applicable law or general principles of using the Internet or defying the reputation of Ground Game.
- A person who has been deprived of the right to use the Online Store may not re-register without the prior consent of the Ground Game.
- In order to provide secure data transmission when using the services provided by the Online Store, the Online Store takes technical and organizational measures appropriate to the degree of security threat to the services provided, in particular measures to prevent the unauthorized access and modification of personal data.

The Client is obliged in particular to:
- not providing or forwarding content prohibited by law, e.g. content that promotes violence, defamatory or violates personal rights and other rights of third parties,
- use the Online Store in a way that does not interfere with its operation, in particular through the use of specific software or devices,
- not taking actions such as: sending or placing unsolicited commercial information (spam) as part of the Online Store,
- using the Online Store in a way that is not inconvenient for other Clients and for the Ground Game,
- use any content posted on the Online Store only for personal use,
- use the Online Store in a manner that is compliant with the the laws applicable on the territory of Ireland and European Union, compliant with Terms, as well as the general principles of using the Internet.

Conclusion of the Sales Agreement
- Information about the Goods provided on the Online Store's pages, in particular their descriptions, technical and functional parameters as well as prices, constitute an invitation to conclude a Sales Agreement, within the meaning of art. 71 of the Civil Code.
- In order to conclude a Sales Agreement via the Online Store, go to the groundgame.ie website, select products, take further steps based on the messages displayed to the Client and the information available on the website.
- The selection of the Goods ordered by the Client is made by adding them to the basket.
- When placing orders - until you press e.g. "Order with the obligation to pay" or other information, which informs about the obligation to pay - the Client has the possibility to change the entered data and selected Goods. To do this, follow the messages displayed to the Client and the information available on the website.

After providing all necessary information by the User, a summary of Order is displayed. The summary of the placed Order will contain the following information:
- the subject of the Order,
- unit and total price of ordered products or services, including delivery costs and additional costs (if any),
- selected payment method,
- selected delivery method,
- delivery time,
- To place an Order, it is necessary to accept the Terms, provide personal data marked as mandatory and press the "Order with the obligation to pay" button.
- Placing the Order by the Client constitutes a declaration of will to conclude a Sales Agreement with Ground Game in accordance with the Terms.
- After placing the Order, the Client receives an e-mail, containing the final confirmation of all essential elements of the Order.
- The Sales Agreement is treated as concluded when the Client receives the e-mail referred to above.
- The Sales Agreement is concluded in English, with the content in accordance with the Terms.
- Clients can access these Terms at any time via the link found on the home page of groundgame.ie and download it and print it out.
- The access to the Order information and the Terms is provided via email.

Delivery
- The delivery of the Goods is limited to the territory of the Ireland and takes place at the address provided by the Client while placing the Order.
- Delivery of the ordered Goods is made by courier, through DPD Courier. Delivery costs are available at: https://groundgame.ie/eng-delivery.html. Delivery costs will also be indicated at the time of placing the Order.
- The delivery time is from 1 to 14 working days counting from the date of placing the Order by the Client and its payment.

Pricing and payment methods
- All prices are provided in Euro (EUR) and include all applicable taxes and fees.

- Payment using IAI Stripe.
- Payment via PayPal.

The right to withdraw from the Sales Agreement
- Only the Client who is also a Consumer has 30 days to withdraw from the Sales Agreement. The Consumer has the right to withdraw from Sales Agreement within 30 days without giving any reason. The deadline to withdraw from the Sales Agreement expires after 30 days from the date on which the Consumer came into possession of the last item or in which a third party other than the courier and indicated by the Consumer came into possession of the last item.

about his decision to withdraw from Sales Agreement. - The customer may use the return form provided by Ground Game, but it is not mandatory.
- To withdraw from the Sales Agreement, it is enough for the Client to send information about decision to use the right to withdraw from the Sales Agreement before the deadline to withdraw from the Sales Agreement.

Effects of withdrawal from the Sales Agreement
- In the event of withdrawal from Sales Agreement, we return to the Client all payments received from the Client, including delivery costs (except for additional costs resulting from the delivery method chosen by the Client other than the cheapest method of delivery), immediately, and in any case not later than 14 days from the date on which we were informed about the Client's decision to use the right to withdraw from Sales Agreement. We will make refund using the same payment methods that were used by the Client in the original transaction, unless the Client expressly agreed to a different solution; in any case, the Client shall not incur any fees in connection with this return.
- We can withhold the return of the payment until receipt of the products or until proof of its return is provided to us.

immediately, and in any case not later than 14 days from the date on which the Client informed us about the withdrawal from Sales Agreement. The deadline is met if the Client sends the products back before the end of the 14-day period. - The customer bears the direct cost of returning (sending back) products.
- The customer is responsible for reducing the value of products resulting from using it in a different way than was necessary to establish the nature, characteristics and functioning of products.

Complaints regarding Goods
- Ground Game as the seller is liable to the Client being a Consumer within the meaning of art. 22 [1] of the Civil Code, under the warranty for defects in the scope specified in the Civil Code, in particular in art. 556 and art. 556 [1] - 556 [3] and subsequent Civil Code.

Complaints arising from violation of rights guaranteed by law or pursuant to these Terms should be sent to the following address:

Ground Game undertakes to review each complaint within 14 days. Failure to examine the complaint within the above deadline signifies the acceptance of the complaint.

Complaints regarding the provision of electronic services
- Ground Game takes measures to ensure fully correct operation of the Online Store, to the extent that results from current technical knowledge and undertakes to remove within a reasonable time any errors or problems reported by customers.
- The Customer is obliged to immediately notify Ground Game of any errors or interruptions in the functioning of the Online Store.
- Errors related to the functioning of the Online Store may be reported by the Client in writing to the following e-mail address: info@groundgame.ie or using the contact form.
- In the complaint, the Client should provide his name and surname, address, detailed description and date of error or problem occurance.
- Ground Game undertakes to review each complaint within 14 days. Failure to examine the complaint within the above deadline signifies the acceptance of the complaint.

Dispute resolution and final provisions
- A Client who is a Consumer may use out-of-court dispute resolution. Disputes regarding online purchases can be solved through mediation proceedings using the Provincial Inspectorates of the Trade Inspection or before the arbitration court at the Provincial Inspectorate of Trade Inspection. The consumer may also use other methods of out-of-court dispute resolution and, for example, file a complaint through the EU ODR online platform, available at: http://ec.europa.eu/consumers/odr/
- If the Consumer is not interested in the possibility of using out-of-court dispute resolution, resolution of any disputes arising between the Ground Game and the Consumer will be subject to the competent courts in accordance with the relevant provisions of the Code of Civil Procedure.
- Settlement of any disputes arising between the Ground Game and the Client, who is not a Consumer, shall be settled by the district court applicable for Ground Game headquarters.
- In matters not covered by these Terms, the provisions of the Civil Code, the provisions of the Act on the provision of electronic services, RODO and other relevant provisions of the Irish law shall apply.
